HALLOWEEN AT OAKWOOD PARK

Dear People Of Venice:

We who love children and all children, need to weigh in on this immediately.

We have sat in at Oakwood Park Advisory Board meetings monthly and tonight those of us who attended learned that some of the children of Oakwood who are involved in football activities and cheer leading would not be able to attend a tradition of having Halloween Festivities being held at Oakwood Recreation. When two Parents brought this to the attention of the Park Advisory Board (One was a Grandparent who oddly enough is the President of the board) the reply to them was: 

"Well believe it or not the Westside Bulldogs children are not the only children in the neighborhood", stated by the Park Director Lizka Mendoza.

That is true, but their needs must be considered too. All children should have the opportunity to attend since it's children this great party is being held for.

Let's give respect to all the children of the community. It's rare that it falls on a Saturday and it will be great fun for them to come and enjoy all the wonderful activities that are planned for them that night. I know we can make this work for all the children of Venice.

The Park Advisory Board (PAB) didn't have a say on the time, and this is what some of their duties entail, and their input could have assisted in the time being workable for all.

We need transparency and most of all, accountability, in running Oakwood Park. If organizations give they should do this with no strings attached. Excluding children shouldn't be overlooked because enough questions weren't asked, and Park Advisory Board members weren't consulted. Let's right this and get the hours changed as suggested by two board members, Lydia Ponce and Jataun Valentine

VNC Board Adopts Bylaws Amendments required for April 11, 2010 VNC Board Election

(See LA City Clerk 2010 NC Election Policies)

At its September 15, 2009 meeting, the Board adopted several Bylaws Amendments.

Changes to Bylaws III, IV, and VI were necessitated to bring the Venice Neighborhood Council into conformance with City of Los Angeles mandates approved by the LA City Council. They must be ratified by VNC stakeholders at an election to be scheduled. If they are not ratified by VNC stakeholders, the City Clerk has established default guidelines that implement the mandated changes which may not be the same as those described here.

The change to Bylaw V proposed by Rules and Elections Committee allows for smoother running of stakeholder initiative elections.  The bylaws, as amended by the above changes, can be found at:

VNC RECALL PETITION

A petition, started by Rick Selan, a member of Venice Neighborhood Activists Coalition (VNAC) and Stakeholders of Venice (SOV), proposes to recall those officers of the Venice Neighborhood Council (VNC) who refuse to address ethics violations and grievances, filed against the VNC by concerned Venice stakeholders

If you are a Venice stakeholder and agree with this petition, please add your signature and tell your neighbors, family and friends! 

VNC RECALL PROCEDURE

B. Recall: Recall is the procedure by which Voting Members may remove an elected Officer. Any Voting Member may put forth a Recall petition by presenting a petition to the Secretary with no less than two-hundred (200) signatures of Voting Members supporting the motion.

1. Receipt of this completed petition by the Secretary shall trigger this item being scheduled as an action item on the Agenda at a separate Election Meeting to be held not less than thirty (30) days nor more than ninety (90) days following receipt of the completed petition. Notice of the Recall petition, including the name of the Officer subject to Recall, shall be made in all public meeting notices and announcements for the upcoming meeting at which the Recall shall be voted on.

2.   Removal of the Officer by Recall requires a three- quarters (3/4) majority vote of the Voting Members present and voting at the Election Meeting, not to be less than two-hundred (200) votes in favor of the Recall.

Dr. Armond Tollette abandoned traditional medical practice to focus on medical marijuana. California law allows physicians to recommend marijuana for seriously ill patients. A PROPOSAL BY THE VENICE BEACH BOARDWALK COALITION (VBBC)

CHANGING THE REGULATION OF COMMERCE IN THE FREE SPEECH ZONE ON VENICE BOARDWALK

INTRODUCTION

The battle for Free Speech on Venice Beach has been waged, on and off, since 1991, when a lawsuit, Alliance for Survival v. City of Los Angeles, claiming violations of 1st Amendment rights, was filed by the ACLU on behalf of Jerry Rubin, SHAPE and The Benefit Network. This lawsuit successfully established 1st Amendment protected vending for nonprofits, churches and politicos in what came to be known as the “Free Speech Zone” (FSZ) on the west side of Venice boardwalk. Following this, in 1997, Perry v. LAPD, US 9th Cir Appeals won 1st Amendment protection for street artist Harry Perry, and others, to sell their CDs, banners, T-shirts and buttons in the FSZ.

From 1995 to 2005, a span of ten years, the conditions in the FSZ deteriorated. Many ‘vendors’ appeared with false documents claiming affiliation to churches and other nonprofit entities;  others claimed religious ideology by placing crosses and religious symbols on pieces of cheap, mass-produced jewelry (actions condoned by LAPD, Rec. & Parks, and the City Attorney).  As a result, illegal, unprotected commercial vending proliferated in the guise of 1st Amendment activities, leading to ruthless competition for space and location. Many of the original Free Speech activities such as those operated by nonprofit organizations, churches and political activists were squeezed out in a hostile takeover by (ruthless) commercial vendors looking for a profit.

The City of Los Angeles’ response to the ensuing ‘space war’ was to impose a permit/lottery scheme into LAMC 42.15, in 2005, in an attempt to control the situation.   As a result of offensive enforcement procedures and blatant 1st Amendment violations executed by LAPD officers, four lawsuits were filed against the City from 2005 to 2007.  The ultimate cost of which now approaches $1 million in damages and attorneys’ fees paid out by the City.  A new lawsuit has just been filed. 

As of the date of this document, illegal, unprotected commercial vending continues to proliferate, unabated, on Venice boardwalk, exacerbated by the City’s lack of enforcement of the current LAMC 42.15 ordinance.  Because the current permit/lottery system results in the daily violation of citizens' First Amendment protected rights to free speech and peaceable assembly, it is “repugnant to the constitution and is void.”  (Marshall).  The following proposal has been created by a group of concerned citizens, the Venice Beach Boardwalk Coalition (VBBC) whose purpose is to restore and preserve First Amendment standards in the Free Speech Zone.   

Mission Statement 

To legally remove vendors selling merchandise that is not protected by the First Amendment, from space reserved for constitutionally protected free expression, in the Free Speech Zone (FSZ) on Venice Beach Boardwalk and to remove the permit/lottery system and designated space allocations*, returning to the conditions of the original LAMC 42.15 code.  This to be achieved by constructing clear, concise and easily enforceable laws regarding what constitutes First Amendment protected vending on the Boardwalk. 

(* Since at least sixty percent (60%) of the current vendors on the Boardwalk engage in blatant unprotected commercial vending, with the number being potentially more than eighty percent (80%), it is expected that designated space allocation will be unnecessary.  It is further expected that with the removal of commercial vendors, who tend to be aggressive in space occupation, the level of conflict on the Boardwalk will be greatly abated.)

On Friday, October 2nd, the Boys & Girls Club of Venice hosted their 4th Champion of Youth Gala at the Ritz Carlton in Marina Del Rey. They honored Nancy & David Iben with the Champion of Youth Award and FIDM with the Corporate Leadership Award. The Fourth Annual Champion of Youth Gala's main purpose is to highlight the extraordinary programs and people associated with the Club, and to raise money to go towards sponsoring scholarships for club members, and enhancing core programs such as the arts, character and leadership development, sports, fitness and recreation, and education.
